Teens who microwaved cat get probation

Two Alberta teens who admitted to killing a cat in a microwave oven were sentenced Thursday to one year probation and 100 hours of community service.

The boys, both 16, were also barred from owning pets for two years, and ordered not to possess or play violent video games.

The ban on pet ownership means one of the teen's families will have to give up a dog they bought 10 months ago.

The teens pleaded guilty in June to breaking into a house in Camrose, about 100 kilometres southeast of Edmonton, over two nights in December 2007 while the owners were away for Christmas.

In an agreed statement of facts presented to court in June, the teens said they ransacked the home, smashing guitars and a television. On the second night, they put the family cat in the microwave and ran the oven for 10 minutes while the animal screamed in pain.

On their way out of the home, the statement said, they painted two messages on the walls.

"It's in the microwave," one message said. The other read, "You had a nice cat."

In Thursday's sentencing hearing, the teens told the court they were very sorry. They cannot be identified under the Youth Criminal Justice Act.

"Overall I'm content with the result," said Crown prosecutor John Laluk. However, he said, current animal cruelty legislation limits the judge's options.

"You can't get more jail than an adult would get," he said, referring to the ages of the teens.

"If an adult ... doing the worst offence would get six months, what would you give the 15-year-old with no record? You would end up in the same position. It's unfortunate, but that's the way right now the legislation deals with animal cruelty.

Chris Millsap, one of the defence lawyers, called the sentence "appropriate."

"It's certainly not something that's out of line for the offence. [It will] be difficult for some people to accept, I'm sure. It's certainly in line."

"People who know him know that he's a good kid who did something bad, as opposed to a bad kid simply acting as he otherwise would," Millsap said of his client.

But activists say the sentence may not be strong enough to make the teens change their behaviour or make them more aware of animal cruelty issues.

"I think its very light punishment for the kind of crime these kids have committed and especially considering that it was, I think, really premeditated," said Tove Reece of Voice for Animals.

"But I mean we also recognize that the judge had her hands tied. She could not give them jail time."

Two other teenagers charged in connection with the same incident have pleaded not guilty, and are scheduled to go on trial on Nov. 17.
