Neonazi trying to trade mark the term "Hardcore"

barc0debaby - 3-23-2009 at 10:11 PM

Re post from SOIA message board.

Please check this out. This has been brought to our attention we have written the German trade mark office and are trying to get people aware. Please do what you can.

www. keinbockaufnazis. de doesn't put up with the latest shocking news and neither should you! The german Neonazi Timo Schubert trademarked the term "Hardcore". If he gets the ratification, it would be a disaster for the whole scene! We got to know of this just by fluke and now try to mobilize as much people as we can to prevent a legal validity. The opposition period expires END OF MARCH. First of all our Lawyer applied for cancelation of the entry. Quite possible that they dismiss our petition. If so, we will file an objection together with some Fanzines, Mailorders and Recordlabels.

This would become very expensive because of the lawyer's fee.

Now here's what you can do:

1.

Make it public! Inform all of your friends, bands, clubs and labels. Repost this bulletin. Link our website so that everyone keeps up to date.

2. Write a nice but certain mail to the "German Patent and Trade Mark Office" (info@dpma.de) and tell them what you are thinking about this action.

3. We are selling a "Hardcore"-Shirt in our onlineshop - now more than ever! We will pay the Lawyer’s fee with the profit of this "Hardcore-Savior-Shirt".
So get one in our shop!

And if the Neonazi want’s to sue us for the shirt – the heck with it! They won’t get us down! Hardcore will always be against Nazis! Send your protest-mails to the "German Patent and Trade Mark Office": info@dpma.de

this has been all over myspace today.

Who cares? What can some jackoff do with a German trademark on hardcore? Nothing.

What's the chances of Germans beating the shit outta this guy if he ever shows his face at a show to complain about them using his "trademark?"

moforn - 3-24-2009 at 02:35 AM

I'm no legal expert, but wouldn't this guy have to prove to have originated the term to patent it?

he can sue every band that uses the term hardcore on their merch or record.

XHonusWagnerX - 3-24-2009 at 06:09 AM

does that mean I could trademark the term "Jazz" or "Folk"?

clevohardcore - 3-24-2009 at 09:27 AM

Sue who? Bands that aren't incorporated as real businesses? Band members who don't use their real names anywhere? And furthermore...bands that don't make any real money anyway? Maybe he could sue record labels, maybe.

Voodoobillyman - 3-24-2009 at 05:23 PM

This is a waste of time and effort. Who gives a shit?

If a band doesn't make any real money, you can sue the individuals.

First of all, no German guy is going to sue a billion indie HC labels for $3 profit. Thats just assinine. Bigger labels? You going to sue for $10 profit? Good luck. Hope lawyer fees and years of litigation over bad music and half ass managed labels is worth his time.

Let him copyright it. Most hardcore bands and labels suck anyway, this way the real people will go underground and do something creative for once instead of apeing each others shit. This whole debacle needs to come crashing down anyway.
