Falls on your car in your driveway. Do you do anything about it? Because I went on my own to 2 differrent auto tepair places got 2 seperate estimates and walke dthem over to my neihgbors house. In a friendly manner I said I got the 2 estimates for the truck damage, and I wanted give you 2 copies of them along with the pictures. So you can forward them to your insurance and we can get his taken care of. He said "I'm not doing shit".

What would you do? You can be funny or serious. I am just suprised I have not hurt him yet. I guess when you get a little older you realise. Everyone will try and get one up on you. even when your neighbor is 55 years old. It won't happen. Your tree. My property. You fix my shit. I am applying for small claims court tomorrow. LETS GET IT ON!!!!!

Ya I am in the process of putting my house on the market. I painted the livingroom and kitchen over the weekend. Shit is hectic. Now this joker is tryin to snake out of taking care of what happened. he has always been a nice neighbor to thats the fucked up thing. If I got to light the spark under his ass to actually take care of this well I brought the matches.

exactly, and that's what home owners insurance is for. although (if he owns), he'd be a fool to put a claim in. better to just pay you than to risk a rate hike.

That is what his homeowners insurance is for. But don't let him off on this shit. Believe me, I've had to spend some time in small claims court for school and people come in with shit that's a lot less than $1400. It's not unusual. If you file papers with small claims court and serve his ass then it's likely he'll relent and pony up the cash because he won't want the hassle of going to court and he won't want a judgement against him where he could end up paying more because of court costs and such.

According to his insurance and the state of Ohio they are not liable. No prior claims or complaints have ever been filed on their tree. So they are not negligent. UNFUCKING BELIEVALBE.

I understand that they can't be held accountalbe for wind or weather since they are not in control of that but if a neighbors property damages your property and they did not physically cause the damage they are not responsible. So now in the State of Ohio I had to contact MY INSURANCE company and they had to cover it. I am the lucky one who gets to fork over $250. for my deductable and 4 days of my time while the truck is in the shop. And I have another claim on my insurance record. Thanks neighbor.

i mean, i guess it makes sense. had the limb been dangling there for a year and you called to complain every month, i guess then you would have had a chance? all the same, dude should at least offer to split it with you.

have you already contacted your insurance company? are you gonna put in the claim, or just pay to have it fixed? i'd be worried about rate increase.

I already did the claim. My deductalbe is 250 and the total is 1700. Plus they will add the rental vehicle to it. I am very pissed right now.
