I love how at the end they throw in "this is the first time this has come up in a New York State divorce case." Like it happens on a daily basis everywhere else.

Sad that I know this...

He probably won't get crap for the "monetary value" of the kidney. It's illegal to sell body organs in the US, so they have zero monetary value. There are some insanely interesting ways that people get around it for kidney "donations" where two (or more) people who need a new kidney and have incompatible donors will find each other and swap donors who are compatible. The transplants take place simultaneously so that the "later" donor can't back out. Crazy, but true. I think they've done up to a quadruple transplant... maybe a quintuple.

When I needed a kidney transplant my stepfather talked about donating to someone he was a match for if one of their family members donated to me. Nothing came of it. And it's still a donation any way you look at it. It's just one family helping out another. Nobody in my family was a match for me so my stepfather wanted to see if another family was in the same situation and maybe we could help each other out.

As for asking for your kidney back in a divorce... what an idiot. Sounds like the dude is just bitter.

Theoretically he could potentially get rewarded the equivalent of any costs that he incurred for the procedure that his insurance company didn't pick up. Which would likely be whatever his co-pay was.
