#1 that ladies life is basicly ruined and she only got $470,000 as a setlement??
#2 Wal*mart needs money that bad? I get why they dont want to make an exception, but what the fuck... why do they need that 'fine print' anyway? The
fucking insurance company paid the medical expenses. If Wal*mart is 'self insured' its not that womans fault!

Bush has essentially put a cap on lawsuits. I remember seeing a show on the Discovery Channel about surgical tools that were left behind. The most
anyone got was a guy who had scissors in his gut and caused him all kinds of issues, he got 400,000.

I'm all for following the letter of the law in terms of contracts, and I can even understand the position Wal Mart is taking as it doesn't want to set
a legal precedent. If they do it once, it will happen again. Those affected previously could sue to get their money back with interest.
That being said, it's pretty fucked up to go after this family. They should have looked at the set of facts and said fuck it. If anything, I think
Wal Mart should have gone to the family and get them to sign a confidentiality agreement stating they could never discuss the matter with anybody and
let them keep the money. That way the family can keep the money it desperately needs, and Wal Mart doesn't have to worry about their goodwill gesture
being used against them in the future.

I agree with all of that.
My biggest gripe is not that Walmart is holding the family to the contract that they agreed to, but the fact that they included the right to take
money from the families in the contract at all. The people pay for insurance... if they have to use the insurance then so be it, thats why they pay
for it. Im sure that the $470,000 that the woman was awarded was not ALL for medical bills. Im sure that a good portion was for 'pain & suffering' and
the fact that she has a permanent ongoing situation. So Walmart wants to take ALL of the money she got? I dont care what the bills totaled even
following the contract 100% they should only be able to take a portion that the courts dictated as being for medical expenses.
